Donald Trump Seeks Supreme Court Review of E. Jean Carroll Case

President Donald Trump has formally petitioned the US Supreme Court to overturn a $5 million civil verdict holding him liable for sexually abusing and defaming writer E. Jean Carroll in the mid-1990s. ⚖️🇺🇸

The filing, submitted Monday (November 10, 2025), argues that trial Judge Lewis Kaplan made critical errors by admitting “highly inflammatory” evidence, including testimony from two other women accusing Trump of similar assaults and the infamous 2005 Access Hollywood tape where he boasted about groping women.

Trump’s team claims these rulings violated federal evidence rules, propped up Carroll’s “implausible” story, and created a conflict with other appeals courts’ precedents—potentially warranting Supreme Court review.

The petition stresses: “There were no eyewitnesses, no video evidence, and no police report or investigation.” It accuses Carroll of waiting over 20 years to level “false” claims for political and financial gain after Trump became president.

A federal appeals court upheld the 2023 jury verdict last year, and the full 2nd Circuit denied rehearing in June. The case hasn’t been docketed yet at SCOTUS, where the conservative majority (including three Trump appointees) will decide whether to hear it.

This isn’t Trump’s only Carroll battle at the high court. He’s seeking full 2nd Circuit review of a separate $83.3 million defamation award (upheld in September), with the Justice Department backing scrutiny of presidential immunity waivers for “official acts.”

Carroll’s lawyer Roberta Kaplan previously said no issues merit SCOTUS review. Trump’s team calls it part of fighting “Liberal Lawfare” and “Democrat-funded” hoaxes.

The cases stem from Carroll’s allegation of assault in a Bergdorf Goodman dressing room; Trump denies everything, saying she’s “not my type” and fabricated it for book sales.
