Ex-Top Flight Footballer Wins Legal Battle Over Unnecessary Surgery

By Peter.

Former Premier League and Wolverhampton Wanderers striker Sylvan Ebanks-Blake has won a landmark medical negligence lawsuit worth over £7 million against orthopaedic surgeon Professor James Calder. In a High Court ruling on Thursday, December 18, 2025, Mrs Justice Lambert found the surgeon breached duty by performing an unnecessary ankle arthroscopy during treatment for a 2013 leg fracture—procedures that caused permanent stiffness and prematurely ended the 39-year-old’s top-flight career.

The judge ruled the additional surgery—removing cartilage and microfracturing bone—was “neither reasonable nor logical” on a pain-free ankle, rejecting defense claims it prevented future issues. Ebanks-Blake, symptom-free pre-op, would have played “at a high level” for 3–5 more years without it, per the judgment. Damages (lost earnings, ongoing physiotherapy, psychological support) will be quantified later.

Case Background: From Wolves Star to Career-Ending Surgery

  • Injury (2013): Ebanks-Blake suffered a lower leg fracture playing for Wolves.
  • Contested Procedure: During fixation, Calder performed arthroscopy + microfracture on the ankle, claiming preventive benefits.
  • Aftermath: Post-surgery stiffness/pain forced steroid injections; career declined from Premier League/Championship to lower leagues/non-league. Retired 2019 after another fracture.
  • Claim: Barrister Simeon Maskrey KC: “Pain and stiffness from the ankle—not the fracture—ended his professional income.”

Defense (Martin Forde KC): Treatment supported by elite sports surgeons. Judge sided with claimant: Breach of duty clear.

Ebanks-Blake’s Career Highlights

  • Youth at Manchester United.
  • Breakthrough at Wolves (2007–2013): 64 goals in 193 games; key in promotions.
  • England U21 international.
  • Post-Wolves: Ipswich, lower tiers; retired at 33.

The victory spotlights risks of invasive procedures on asymptomatic joints in athletes—potentially setting precedent for sports medicine negligence claims.

Ebanks-Blake’s team hailed a “bittersweet” win after years of pain; no comment yet from Calder.
